PHOTO POLICY
401DutchDivas is a non-profit volunteer website that showcases Dutch singers from the past and present. The portraits of post-war singers were created in collaboration with the singers themselves or their relatives, largely by the website's founder, the late Joop Lindeijer. We use these images in good faith. The biographies on this website serve solely to promote the composers and their work. No commercial interest is served by them. Therefore, the images used fall under the globally accepted "fair use" principle, the compass by which Wikipedia and Wikimedia Commons also operate. Recently, aggressive copyright groups have become active, placing bizarre claims on postage-stamp-sized photos, which they "track down" using obscure dragnet techniques. Under penalty of draconian "fines," they order amateur websites to "remove" images. Well, for us, it's very simple: if a photographer or a family member finds/thinks we are not allowed to use photo X or Y, we remove the photo immediately and without discussion. There's no need for threats at all. Too bad for the singer from the distant past, who thus slips back into completeoblivion. Which makesus ask those coming on so strong: what's the point?
This aggression is not without consequences: in post-war categories, we have meanwhile removed dozens of biographies of Dutch singers, particularly from the 1970s and 1980s, as a precaution. To be clear: the images used in the past were provided to us by these singers and their descendants, but since many of the singers from Lindeijer's days (the Hein Meens & co category) are no longer with us, we can no longer prove 'use with permission.'
Still, when it comes to 'proof' we believe that the correspondence of visitors of the site and Lindeijer 2001-2010 makes a strong case: dozens of children of the singers on this website respond there with input, photographs, and archives. DutchDivas meanwhile governs the personal legacies of Gré Brouwenstijn, Cristina Deutekom, Annie Delory, and Ank Reijnders, to mention but a few.
Oh yeah... in case someone might think we quickly grabbed the accompanying photo to this page from the internet, we didn't. It was created by us with an AI image generator.
